BTC Justice - Alternative Measures Program
The Alternative Measures/Extrajudicial Sanctions Program provides restorative justice alternatives for those facing criminal charges. Designed to offer pathways outside the traditional court process, this program emphasizes conflict resolution, accountability, and community-based healing.
What is Alternative Measures?
The Alternative Measures Program is a pre- or post-charge program that diverts offenders from the formal court process. Through mediation or diversion, offenders have the opportunity to take responsibility for their actions and address the harm caused, allowing for rehabilitation without a permanent criminal record.
Eligibility and Referral Criteria
-
Eligible Participants: Adults and youth (12-17 years old) who accept responsibility for their offense and agree to participate in the process.
-
Limitations: Generally, participants can only access alternative measures twice within two years, and eligibility may exclude individuals with serious criminal backgrounds.
-
Offenses Covered: Eligible offenses typically include theft, mischief, minor assaults, fraud, and certain drug-related charges. More serious offenses like those involving weapons, violence against persons, and sexual offenses are excluded.
Process for Resolving Cases
Some common processes for resolving cases include:
-
Victim-Offender Mediation: Direct mediation between the victim and offender to address harm and seek resolution.
-
Community and Family Group Conferences: Involves the offender, their family, and community members to collaboratively find a resolution.
-
Specialized Referrals: Referrals to counseling, mental health programs, or other support services to aid rehabilitation.
Possible Case Outcomes
Outcomes are tailored to foster accountability and healing, and may include:
-
Formal apologies to the victim
-
Community service or personal service work for the victim
-
Participation in cultural or spiritual activities
-
Educational programming, short essays, or specialized treatment
By offering constructive alternatives to incarceration, the Alternative Measures Program promotes accountability and allows individuals to take responsibility in ways that benefit both the community and the offender.
